Terms of Service

Effective date: September 10, 2025

1. Acceptance of Terms

By accessing or using ALBANOWSKA URSZULA’s websites, products, monitoring services, or requesting a consultation (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Services.

If you accept these Terms on behalf of an entity, you represent that you have authority to bind that entity.

2. Eligibility & Accounts

You must be at least 18 years old to place an order or enter into a contract with ALBANOWSKA URSZULA. You are responsible for safeguarding your account credentials and for all activities under your account.

Account information

  • Provide accurate, current, and complete details.
  • Promptly update account information when it changes.
  • Notify us of any unauthorized use or security breach.

3. Orders, Quotes & Installations

Quotes are valid for the period stated on the quote (or 30 days if unspecified). An order is deemed accepted once you receive a written confirmation or installation is scheduled.

Site survey & installation

  • We may require a site survey to validate feasibility and compliance.
  • Customer is responsible for ensuring safe access, power, and network availability.
  • Any additional works (e.g., cabling, trenching) not included in the quote will be billed separately.

Title to hardware transfers upon full payment. Risk of loss passes on delivery to the site.

4. Pricing, Billing & Taxes

Prices are shown in EUR and include VAT where applicable, unless stated otherwise. We may adjust prices due to changes in taxes, supplier costs, or regulatory requirements. If you subscribe to monitoring or cloud services, recurring fees will be billed as agreed in your service plan.

Payment terms

  • Invoices are due within the timeframe indicated on the invoice.
  • Late payments may incur interest and collection costs as permitted by law.
  • We may suspend or cancel Services for unpaid invoices.

5. Monitoring & Support

Monitoring is provided on a reasonable efforts basis and may depend on third-party networks and infrastructure. Response times are targets and not guarantees unless expressly stated in a signed SLA.

Maintenance windows

We may perform scheduled maintenance with prior notice. Emergency maintenance may occur without notice to preserve security or safety.

6. Access, Site Readiness & Customer Obligations

  • Provide timely access to premises and reasonable cooperation.
  • Ensure compliance with building regulations and obtain necessary permits.
  • Use the equipment and Services in accordance with instructions and law.

7. Warranties & Remedies

Hardware is covered by the manufacturer’s warranty or the warranty specified in your quote (e.g., 12/24/36 months). Our installation workmanship warranty covers defects attributable to our installation within the stated period.

Warranty excludes misuse, unauthorized modifications, accidents, acts of God, or issues arising from third-party services (e.g., ISP outages).

8. Privacy & Data Processing

We process personal data in accordance with our Privacy Policy and applicable law (including GDPR where relevant). Where ALBANOWSKA URSZULA acts as a processor for customer-controlled CCTV or access logs, we will process data solely on customer instructions.

9. Intellectual Property

All trademarks, software, documentation, and content provided by ALBANOWSKA URSZULA remain our or our licensors’ property. Customer receives a limited, non-exclusive, non-transferable license to use software and documentation solely for the intended purpose during the term.

10. Prohibited Uses

  • Bypassing safety controls or interfering with monitoring operations.
  • Illegal surveillance or processing of personal data without lawful basis.
  • Reverse engineering, decompiling, or circumventing license restrictions.

11. Limitation of Liability

To the maximum extent permitted by law, ALBANOWSKA URSZULA is not liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, data, goodwill, or business interruption. Our aggregate liability for claims is limited to the amounts paid by you for the Services giving rise to the claim in the 12 months preceding the event.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold ALBANOWSKA URSZULA harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your unlawful use of the Services, breach of these Terms, or violation of third-party rights.

13. Term & Termination

Either party may terminate for material breach not cured within 30 days of written notice. We may also terminate where required by law, for non-payment, or if providing the Services becomes impracticable due to factors outside our control.

Upon termination, your right to use Services ceases, and outstanding amounts become immediately due.

14. Changes to the Services & Terms

We may update the Services or these Terms to reflect technical, legal, or business changes. Material changes will be communicated by reasonable means. Continued use after the effective date constitutes acceptance.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of France. The parties submit to the exclusive jurisdiction of the courts of Paris, France, unless mandatory consumer law provides otherwise.

Amicable resolution

Before filing a claim, the parties will attempt to resolve disputes amicably within 30 days of written notice.
